FTC Safeguard’s Rule: What you need to know

The Standards for Safeguarding Customer Information Rule (Safeguards Rule) was created to ensure that financial institutions (which includes automotive dealerships) have the necessary security controls in place to protect the private information of their customers. Originally drafted in 2003, the Safeguards Rule was modified in 2021 to meet the changing technological landscape and address the increased threats of data breaches and ransomware attacks. Automotive Dealers have until June 9, 2023 to meet the Safeguards Compliance Standards or could face fines over $50,000 per violation.

Are you compliant?

The Safeguards Rule defines nine key cybersecurity elements that Ohio auto dealers must have in place to protect the confidentiality of customer data, guard against a data breach or cyberattack, and prevent unauthorized access into your systems and applications. The nine elements include:

  1. Implement and supervise your dealership’s cybersecurity program.
  2. Assess your risks.
  3. Design a plan to assess those risks.
  4. Test the effectiveness of your safeguards.
  5. Train your staff in cybersecurity best practices.
  6. Monitor your service providers and vendors.
  7. Keep your security controls up to date.
  8. Create a written incident response plan.
  9. Report to your Board of Directors.
